Beijing Jingsh (Shenzhen) Law Firm’s International Affairs Committee Holds Cross-Border Estate Succession Seminar and Launch Ceremony for the Handbook on Foreign-Related Succession Legal Services To further enhance professional capacity in foreign-related legal services, deepen practical exchange in cross-border succession and family matters, and advance the consolidation of experience into professional deliverables, on 29 October 2026 Beijing Jingsh (Shenzhen) Law Firm held a “Practical Seminar on Cross-Border Estate Succession and Launch Ceremony for the White Paper on Foreign-Related Succession Legal Services.” The seminar featured joint presentations by Zhao Baolian, Director of the Firm’s International Affairs Committee and arbitrator, and Chan Sau Chi, a PRC-qualified lawyer and Hong Kong solicitor. The Firm also launched the Handbook on Foreign-Related Succession Legal Services, aiming to unpack the applicable law, procedures, and practical difficulties in succession to estates in Mainland China of foreign decedents and to estates in Hong Kong, and—drawing on real cases—to clarify risk-control points and solutions for Mainland–Hong Kong cross-border succession. At the outset, Ma Jingping delivered welcome remarks and warmly greeted the guests and colleagues in attendance. She emphasised that the seminar exemplified Jingsh Shenzhen’s specialised practice and cross-border collaboration, and noted that, amid deeper Greater Bay Area integration, demand for wealth succession continues to grow. Cross-border succession—at the intersection of the International Affairs Committee and the Marriage & Family Committee—often involves conflicts of laws, document authentication, and procedural disconnects. The handbook systematises real cases, risk points, and workflows, offering valuable reference for the Marriage and Family Committee’s cross-border work. She looked forward to ongoing collaboration between the two committees to help clients bridge legal divides with higher-quality service. Chan Sau Chi spoke on “Succession and Matrimonial Regimes in Hong Kong and Mainland China,” contrasting the two systems on intestacy rules(orde of succession and distrition), and extending to matrimonial jurisdiction, divorce procedure, ancillary relief, and disclosure. Using LKW v DD, she explained the Hong Kong courts’ equal sharing principle and the five-step approach to ancillary relief: identify the assets; assess the parties’ financial needs; decide whether equal sharing applies; consider whether there is good reason to depart from equality; and determine the outcome. She also offered practical guidance on the enforceability, drafting, and review of pre- and post-nuptial agreements in Hong Kong. Zhao Baolian spoke on “Foreign-Related Succession,” covering characterisation of foreign-related succession relationships, PRC rules on foreign-related succession, and the twin pathways of notarial and litigious succession. Drawing on anonymised real cases, she addressed applicable law, Mainland–Hong Kong procedural interface, cross-border document authentication, and proof of foreign law in cases involving estates in Mainland China of foreign decedents and Hong Kong estates of Mainland decedents. One case concerned a Hong Kong resident long domiciled in Shenzhen whose Mainland property was left by will to a current spouse, prompting a challenge by children of a prior marriage—analysing jurisdiction, will validity, and choice of law. Another involved multi-jurisdictional assets and foreign nationality, illustrating the complexity of proving foreign law, characterising matrimonial property, and dealing with estates across regions. She also discussed a Hong Kong will and Mainland bank deposits, explaining the evidential role of Hong Kong probate documents in Mainland disputes and that Mainland estate administration still requires the applicable local procedures. She emphasised that practitioners should weigh situs of assets, habitual residence of the deceased, the will (if any), and the heirs’ status when choosing law and pathway. In the discussion, participants raised questions on applicable law, will validity, succession procedure, and Mainland–Hong Kong interface. Chan and Zhao responded by reference to their presentations and further explored practical issues. The launch of the Handbook on Foreign-Related Succession Legal Services reflects the Committee’s accumulated expertise and practice exploration in this field, and provides a reference for peer exchange and client work.
